This Privacy Policy applies to personal information we collect through:
our websites and online storefronts that link to this Policy;
our customer support channels;
our Device and App, when they connect to our systems; and
marketing and advertising interactions we manage, subject to your choices.
This Policy does not cover third-party websites, apps, or services that we do not control, such as payment processors, shipping carriers, app stores, or Flex. The privacy practices of those third parties apply to their services.
We collect personal information from (a) you, (b) your device or browser, (c) our Device or App, and (d) third parties.
A. Identifiers
Examples: name, email address, phone number, shipping address, account username, device identifiers, and online identifiers such as cookie IDs.
B. Customer records and account information
Examples: account login details, customer support history, and subscription status.
C. Commercial information
Examples: products purchased, order history, shipping details, returns and refunds, and warranty or repair interactions.
D. Payment and transaction information
Examples: partial or tokenized card information, payment method type, transaction IDs, and billing status.
Payment card numbers are generally processed by our payment processors rather than stored directly by us.
E. Internet or network activity
Examples: pages viewed, clicks, referral URLs, interactions with advertisements, browser and device attributes, IP address, and approximate location derived from an IP address.
For regional website routing, we may process a shortened version of your IP address to determine your country. See Section 6.3 for additional information.
F. Geolocation information
Examples: approximate, country-level location derived from an IP address and, where a feature requires it and you have enabled the relevant Device or App permissions, more precise location information.
The Geo-IP routing described in Section 6.3 does not use GPS or other precise device-location information and is used only to determine the appropriate regional version of our website.
G. App/Device and wellness-related data
Depending on the features you use, this may include wellness metrics, sleep-related information, activity or recovery-related data, settings, and usage patterns.
Some of this information may be considered sensitive personal information or consumer health data under applicable laws.
H. Communications
Examples: emails, chat messages, support tickets, survey answers, and reviews.
I. Inferences
Examples: aggregated or inferred preferences or interests, such as information used to personalize your experience or help prevent fraud.
Depending on the Services and features you choose to use, we may collect or process information that may be considered sensitive personal information under applicable law, such as account credentials, precise geolocation, or information concerning health or wellness.
We use sensitive personal information only for the purposes described in this Policy and as permitted by applicable law.
We may use personal information for the following purposes:
Provide the Services: fulfill orders, deliver products, enable App functionality, and provide subscription features.
Regional website routing: determine the appropriate regional version of our website based on approximate, country-level location derived from a shortened IP address.
Account management: create and manage accounts, authenticate users, and apply preferences.
Customer support: respond to inquiries, troubleshoot issues, process returns, and provide warranty support.
Payments and fraud prevention: process transactions and detect and prevent fraud, abuse, and security incidents.
Shipping and logistics: ship products and provide delivery updates.
Product improvement: analyze performance, fix bugs, and develop or improve features.
Marketing and advertising: measure campaigns, show advertisements, and build audiences, subject to applicable opt-out rights and choices.
Legal and compliance: comply with applicable law, enforce our terms, protect our rights, and maintain required records.
We may disclose personal information to the following categories of recipients:
Service providers and processors: hosting providers, analytics providers, customer support systems, email service providers, Geo-IP providers, and other vendors that process information in connection with services they provide to us.
Payment processors: to process payments and manage fraud risk.
Shipping carriers and logistics partners: to deliver products.
Advertising partners: to measure advertising performance, build audiences, and perform cross-context behavioral advertising, subject to your rights and choices.
Professional advisors: such as auditors, insurers, lawyers, and consultants.
Parties involved in corporate transactions: such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
Government authorities and other parties where legally required: including law enforcement agencies and regulators.
We use first-party and third-party cookies, pixels, SDKs, and similar technologies for:
strictly necessary functions, such as security, checkout, and session management;
analytics and performance measurement; and
advertising and marketing measurement and targeting.
Depending on our current website configuration, these tools may include:
Meta Pixel (Facebook/Instagram): to measure advertising performance and build audiences.
Google Ads conversion tracking (Google tag): to measure conversions and manage advertising attribution.
LinkedIn Insight Tag: to measure conversions and build website audiences.
HubSpot tracking: to support marketing automation, analytics, and lead management.
YouTube embeds: potentially using privacy-enhanced settings.
Matomo Analytics: which may be configured with privacy controls such as IP masking and may be self-hosted or vendor-hosted depending on deployment.
Depending on your location and applicable law, you may control cookies and tracking by:
using our cookie preference tool, where available, to manage analytics and advertising cookies;
using your browser settings to block or delete cookies; and
using the opt-out mechanisms described in Section 8, including Global Privacy Control signals where applicable.
We use Geo-IP technology to determine which regional version of our website is most appropriate for a visitor, for example, whether a visitor should be directed to or offered the U.S. or European version of our website.
For this purpose, our server processes your IP address and derives an approximate location at the country level.
To reduce the amount of personal information disclosed to external Geo-IP providers, the process is designed as follows:
the Geo-IP lookup is performed server-to-server;
your browser does not directly connect to the Geo-IP provider as part of this process;
before an IPv4 address is sent to an external Geo-IP provider, the final octet is replaced with “0,” reducing the precision of the address;
we use the Geo-IP information only to determine the relevant country or regional website;
we do not use this Geo-IP process to determine your precise location, create behavioral profiles, or target advertising; and
the country result for the shortened IP network is cached on our server for up to 24 hours in order to reduce the number of external lookups.
Depending on service availability and usage limits, we may use one of the following Geo-IP providers:
IPWHOIS.IO / ipwho.is – Privacy Policy: https://ipwhois.io/privacy
FreeIPAPI, Altdorfer Str. 6, 40237 Düsseldorf, Germany – Privacy Policy: https://freeipapi.com/privacy
ipapi.co, operated by Kloudend, Inc., 1887 Whitney Mesa Dr #4080, Henderson, NV 89014, United States – Privacy Policy: https://ipapi.co/privacy/
As part of a Geo-IP lookup, the selected provider receives the shortened IP address submitted by our server and uses it to return geographic information, primarily the associated country.
These providers may independently maintain technical or API request logs in accordance with their own privacy policies and terms.
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law.
Examples include:
Orders, invoices, and tax records: typically retained for the legally required period.
Account data: retained while your account is active. Following a valid deletion request, we delete or de-identify information where reasonably feasible, subject to legal exceptions and retention obligations.
Device/App wellness data: retained as necessary to provide the relevant Services and features. Depending on the applicable feature, you may be able to delete certain information through the App or by submitting a request.
Marketing and analytics data: retained for a limited period and then deleted, de-identified, or aggregated as appropriate.
Geo-IP routing data: the country-level result associated with a shortened IP network is cached by us for up to 24 hours for purposes of regional website routing.
Retention periods may vary depending on the category of information, applicable law, and the purpose for which the information is processed.
This section applies to California residents to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), applies to our processing.
As described in Section 3, we may collect categories of personal information including identifiers, customer records, commercial information, internet or network activity, geolocation information, communications, inferences, and, depending on the Services used, sensitive personal information.
We may disclose these categories to service providers or contractors for business purposes, including hosting, payment processing, shipping, analytics, customer support, security, and Geo-IP routing.
We do not sell personal information for money.
However, certain advertising and analytics activities may constitute a “sale” or “sharing” of personal information under the CCPA even where no money is exchanged. For example, certain identifiers and internet or network activity may be shared with advertising partners for cross-context behavioral advertising.
You have the right to opt out of such sale or sharing where applicable.
The Geo-IP processing described in Section 6.3 is used for regional website routing and is not used for cross-context behavioral advertising.
We do not knowingly sell or share the personal information of consumers under 16 years of age.
Subject to applicable exceptions, California residents may have the right to:
Know/Access: request information about the categories and specific pieces of personal information we have collected about you and certain information about how it has been used or disclosed.
Delete: request deletion of personal information we collected from you.
Correct: request correction of inaccurate personal information.
Opt out of sale or sharing: direct us not to sell or share personal information, including for cross-context behavioral advertising.
Limit use or disclosure of sensitive personal information: where this right applies to our use of sensitive personal information.
Non-discrimination: not receive discriminatory treatment for exercising your privacy rights.
You or, where permitted, your authorized agent may submit a privacy request by:
Email: info@deep-care.com
Phone: +1 (332) 529-4645
We may also provide web forms or self-service privacy controls through our Site or App.
We may take reasonable steps to verify your identity before fulfilling a request, as required or permitted by law.
If you use an authorized agent, we may require evidence that the agent has permission to act on your behalf and may also verify your identity directly.
We generally respond to verifiable consumer requests within 45 days. Where permitted by law, we may extend this period and will notify you if an extension is required.
Where legally required, we recognize qualifying opt-out preference signals, such as Global Privacy Control (“GPC”), as a request to opt out of the sale or sharing of personal information for the applicable browser or device and, where reasonably possible, associated profiles.
Where required, we provide a “Do Not Sell or Share My Personal Information” or equivalent “Your Privacy Choices” mechanism through our Site, cookie preference tool, or privacy settings.
If you are located in the European Economic Area, United Kingdom, or Switzerland and our processing of your personal information is subject to applicable European data protection law, you may have additional rights and disclosures.
These are provided in our separate European privacy notice. Where both notices apply, we will provide the rights and protections required by applicable law.
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
The Services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13.
If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete it.
We may update this Privacy Policy from time to time to reflect changes to our practices, technologies, legal requirements, or Services.
When we make changes, we will post the updated version and revise the “Last Updated” date above. Where required by law, we will provide additional notice of material changes.
